1. Acceptance of Terms
By completing a booking and submitting payment through this website, you ("the Renter") agree to be legally bound by these Terms of Use and Rental Agreement ("Agreement"). This Agreement is entered into between you and the owner of KW E-Bike Rental ("the Owner"), an individual operating a personal e-bike rental service in Kitchener–Waterloo, Ontario.
If you do not agree to these terms, do not proceed with a booking.
2. Age Requirement
You must be 18 years of age or older to rent an e-bike through this service. By completing a booking, you confirm that you meet this age requirement. The Owner reserves the right to refuse delivery and issue a full refund if the Renter cannot confirm they are of legal age upon delivery.
3. E-Bike Use & Ontario Law
The e-bike provided is classified as a power-assisted bicycle (PAB) under Ontario Regulation 369/09 and the Highway Traffic Act, R.S.O. 1990, c. H.8. As a Renter, you agree to:
- Wear an approved bicycle helmet at all times while riding, as required by Ontario law for riders under 18; strongly recommended for all riders.
- Obey all applicable traffic laws, road rules, and municipal bylaws in the Region of Waterloo.
- Not operate the e-bike while under the influence of alcohol, cannabis, or any impairing substance.
- Not permit any third party to operate the e-bike during the rental period.
- Not modify, tamper with, or alter the e-bike or its components in any way.
- Not use the e-bike for racing, stunt riding, or off-road terrain for which it was not designed.
4. Damage Policy
The Renter accepts full financial responsibility for any damage to the e-bike that occurs during the rental period beyond normal wear and tear. A minimum damage fee of $200 CAD applies for any damage requiring repair. The actual cost of repair or replacement may exceed this amount and will be invoiced to the Renter accordingly.
Damage includes but is not limited to: scratches, dents, broken components, flat tires caused by misuse, damaged battery, bent frame, or theft of the bike or accessories.
In the event of theft, the Renter is responsible for the full replacement cost of the e-bike.
5. Assumption of Risk & Limitation of Liability
Cycling and e-bike riding involve inherent risks, including the risk of personal injury, property damage, or death. By renting this e-bike, you voluntarily assume all risks associated with its use.
To the fullest extent permitted by Ontario law, the Owner shall not be liable for any injury, loss, damage, or death arising out of or in connection with the use of the e-bike during the rental period. This includes but is not limited to collisions, falls, mechanical failure, or third-party actions.
This limitation of liability applies regardless of how the loss is caused, including negligence, except where such limitation is prohibited by applicable law in Ontario.
6. Condition of the E-Bike
The e-bike will be delivered in good working order, fully charged, with safety checks completed. The Renter agrees to inspect the e-bike upon delivery and report any pre-existing damage before riding. Failure to report pre-existing damage may result in the Renter being held responsible.
7. Rental Period & Return
The rental period begins at the agreed drop-off time and ends at the agreed pickup time. The e-bike must be available for pickup at the delivery address at the agreed time. Late returns may be subject to additional charges at the Owner's discretion.
8. Cancellations & Refunds
Cancellations made more than 48 hours before the rental start date are eligible for a full refund. Cancellations made within 48 hours of the rental start date are non-refundable. Refunds are processed through Stripe and may take 5–10 business days to appear.
9. Privacy
Personal information collected during booking (name, email, phone, address) is used solely for the purpose of fulfilling the rental and communicating with the Renter. This information is not sold or shared with third parties, except as required by Stripe for payment processing. Data is stored securely and in accordance with applicable Canadian privacy law (PIPEDA).
10. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Ontario.
11. Amendments
The Owner reserves the right to update these terms at any time. The version in effect at the time of booking applies to that rental.
